These terms govern your use of backlogads.com and any advertising services provided by Mulchan Inc. trading as Backlog (“we”, “us”). By using this site or engaging our services, you agree to them.
What we do
Backlog plans, builds and manages paid advertising campaigns for home service contractors. Our fees cover management of those campaigns. Advertising spend is separate and is paid by you directly to the advertising platforms.
No guarantee of results
We do not guarantee any specific number of leads, cost per lead, booked jobs, or revenue. Advertising results depend on your market, your budget, your offer, your pricing, seasonality, how quickly you respond to enquiries, and changes to advertising platforms outside our control.
Any figures shown on our website, in our advertising, or discussed on a call describe past results for specific businesses. They are not typical, and they are not a projection of your results.
What we do guarantee
- Your campaigns will be live within 14 days of receiving account access and creative assets, or your setup fee is refunded
- We will optimize your campaigns at least weekly
- We will respond to messages within one business day
- You retain ownership of your advertising accounts, pixel data, audiences, landing pages and lead data
Territory exclusivity
Where your agreement names an exclusive trade and market, we will not provide advertising services to another business in that same trade and market for the duration of your agreement. Exclusivity ends when your agreement ends.
Fees and payment
- A one-time setup fee is due before work begins
- Management fees are billed monthly in advance
- A minimum monthly advertising spend applies, as stated in your agreement
- Advertising spend is billed to you by the platforms, not by us
- Fees are non-refundable except where expressly stated
Term and cancellation
An initial minimum term of three months applies, because advertising platforms require roughly four to six weeks to optimize. After the initial term the agreement continues month to month and either party may cancel with 30 days' written notice. On cancellation you keep your accounts, data and assets.
Your responsibilities
- Provide timely access to your advertising accounts, website and CRM
- Provide accurate information about your business, pricing and capacity
- Provide photographs and video of your work, which we cannot manufacture
- Respond to leads we generate — we are not responsible for outcomes where enquiries are not followed up
- Ensure your business holds any licences and insurance your trade requires
- Fund your advertising accounts
Intellectual property
Creative assets, landing pages and campaign structures we produce for you become yours on payment. Our internal processes, templates, frameworks and know-how remain ours. You may not resell or license our services to third parties without written agreement.
Confidentiality
Each party will keep the other's non-public business information confidential. We may reference your business as a client and describe results achieved, with your prior written permission.
Limitation of liability
To the maximum extent permitted by law, our total liability arising from these terms is limited to the management fees you paid us in the three months before the claim. We are not liable for lost profits, lost revenue, lost opportunities, or indirect or consequential damages. Nothing here limits liability that cannot lawfully be limited.
SMS Messaging Program
Backlog, operated by Mulchan Inc., runs an SMS messaging program for people who enquire about our advertising services. Participation is entirely optional.
How you join
You join by completing the application form at backlogads.com and ticking the SMS consent checkbox, which is unchecked by default. We do not add anyone to this program without that explicit action. Consent to receive text messages is not a condition of purchasing any goods or services from us.
What we send
Messages relate to the enquiry you submitted. Specifically:
- Confirmation that we received your application
- Whether your trade and market are available
- Appointment scheduling, confirmations and reminders
- Follow-up about an application you started but did not complete
- Occasional account or service updates if you become a client
Message frequency: typically 2 to 6 messages relating to your enquiry. Frequency may vary depending on your responses and whether you book a call.
Cost
Message and data rates may apply. Backlog does not charge for text messages, but your mobile carrier may charge you for messages sent or received according to your plan. Check with your carrier if you are unsure.
How to opt out
Text STOP to any message from us at any time to cancel. You will receive one final message confirming you have been unsubscribed, and we will not send you further messages.

You may also opt out by emailing hello@backlogads.com. We honour opt-out requests immediately and permanently.
Carrier liability
Mobile carriers are not liable for delayed or undelivered messages. Delivery of text messages depends on your carrier's network and is not guaranteed. We are not responsible for messages that are delayed, undelivered, or delivered to an incorrect number where the number provided to us was inaccurate.
Supported carriers
Our messaging program is supported by major carriers in the United States and Canada. Carriers are not liable for delayed or undelivered messages.
Your privacy
Our Privacy Policy explains how we handle your mobile number and consent record. We do not sell, rent or share mobile phone numbers or SMS consent with any third party for their own marketing purposes.
Age restriction
You must be at least 18 years old to use this site, to submit an application, or to opt in to receive text messages from us. Our services are provided to businesses, and we do not knowingly collect information from or send messages to anyone under 18. If we learn that we have collected information from someone under 18, we will delete it.

Governing law
These terms are governed by the laws of Ontario, Canada, and the courts of that jurisdiction have exclusive jurisdiction over any dispute.

We may update these terms. Material changes affecting an active client agreement will be communicated directly. Continued use of the site means you accept the current version.
